There are several specialty deeds.  But, most deeds in the Washington State are one of three main types:

1. Statutory Warranty Deed – this is the most secure deed and is the standard deed used when purchasing a new house. By using this deed, the seller not only transfers the property but they make a few warranties to the buyers.  They warrant that they are the owner of the property and they have a right to convey it. They also warrant that no one else is possessing the property. That there are no encumbrances against the property (except those set forth in the deed) and that no one with a better claim to the property will interfere with the buyer’s rights. Finally, they warrant that they will defend certain claims for the buyer if they arise.

2. Bargain and Sale Deed – this deed has some of the same warranties as the Statutory Warranty Deed but it does not warrant against someone with a better claim. It only warrants the the buyer will have quiet enjoyment “against the grantor, his heirs and assigns.”

3. Quitclaim Deed- this deed is simply a transfer to the grantee of any rights of ownership the grantor has. It does not warrant that there is an actual ownership or that it is unencumbered if it is. It basically just transfers any interests in the property from the grantor to the grantee.

The type of deed that is used in a particular situation is dependent on the circumstances. Often, a Quitclaim deed is used for quick transaction between related persons or to transfer property in to a living trust.  Statutory Warranty Deeds are often favored in situations where the chain of title needs to have clarity.
